1. About Us
These Terms and Conditions apply to all purchases made through the Hornsey's Boutique website. We operate as a UK-based boutique selling clothing, gifts, and accessories.
Business Name: Hornsey's Boutique
Registered Address: Hornsey's Boutique, 13 High St, Clare, Sudbury, Suffolk, CO10 8NY
Support Email: [email protected]
By placing an order, you confirm you are at least 18 years of age and agree to be bound by these terms.
2. Ordering, Acceptance & Stock Availability
When you place an order, you will receive an automated email confirmation. This confirms receipt of your order and does not constitute acceptance. We reserve the right to refuse or cancel any order due to pricing errors, suspected fraudulent activity, unauthorised resale, or stock unavailability.
Stock Indicators: Any stock level indicators or availability messages displayed on our website are for guidance only and are not final or guaranteed. We reserve the right to cancel or partially fulfil orders if items are subsequently found to be out of stock, regardless of on-site indicators. You will be notified promptly and refunded in full if cancellation occurs.
3. Pricing and Payment
All prices are displayed in GBP (£) and include VAT where applicable. Delivery charges are calculated and displayed at checkout prior to payment confirmation. We reserve the right to correct pricing errors and will notify you before dispatch if a correction affects your order. You will be given the option to proceed at the corrected price or cancel without charge.
Payments are processed securely via Stripe. By completing checkout, you authorise Stripe to charge your nominated payment method. Payment is taken at the point of order placement. We do not store full card details on our servers.
4. Delivery
All orders are dispatched via Royal Mail. We aim to process and dispatch orders within 1–3 working days. Delivery timeframes provided at checkout are estimates and are not guaranteed. Hornsey's Boutique is not liable for delays caused by Royal Mail, customs (if applicable), weather, strikes, or other force majeure events.
Risk of loss or damage to goods passes to you upon delivery to the address provided. Royal Mail's compensation and liability limits apply to items lost or damaged in transit. We will assist with filing claims where possible, but liability remains subject to Royal Mail's current terms and conditions, which are available on their official website.
5. Returns, Refunds & Cancellations
Under the Consumer Contracts Regulations 2013, you have the legal right to cancel your order within 14 days of receiving the goods, without providing a reason. To exercise this right, you must notify us via [email protected] within the 14-day window.
You then have a further 14 days from the date of cancellation notice to return the items. Refunds will be issued within 14 days of us receiving the returned goods in acceptable condition, or within 14 days of you providing satisfactory proof of return postage.
Return Conditions:
- Items must be unworn, unwashed, unaltered, and in original saleable condition with all tags and packaging intact.
- For hygiene reasons, we cannot accept returns on earrings, lingerie, swimwear, or any sealed items where the hygiene seal has been broken or removed.
- Customers are responsible for the cost of return postage unless the item is faulty, damaged, or incorrectly supplied by us.
- We recommend using a tracked postal service for returns. We cannot be held responsible for returns lost in transit without tracking.
6. Faulty, Damaged, or Incorrect Goods
Under the Consumer Rights Act 2015, goods must be as described, fit for purpose, and of satisfactory quality. If you receive a faulty, damaged, or incorrect item:
- You are entitled to a full refund if you reject the goods within 30 days of delivery.
- After 30 days, you are entitled to a repair or replacement within a reasonable timeframe. If this is impossible or unsuccessful, you may request a price reduction or final refund.
- Please contact [email protected] with photographs and your order number. We will cover return postage for verified faulty or incorrect items and arrange a replacement or refund promptly.
7. Disputes & Chargebacks
We are committed to resolving all customer issues directly and efficiently through the returns and refund process outlined in Sections 5 and 6. If you experience an issue with your order, please contact us before escalating a dispute with your bank or payment provider.
Stripe Dispute Process: Payment disputes and chargebacks are processed through Stripe's formal dispute resolution framework. If you initiate a chargeback without first contacting us to resolve the issue through our stated procedure, Hornsey's Boutique reserves the right to seek reimbursement for reasonable administrative costs and third-party payment processor fees incurred as a direct result of the out-of-procedure dispute. This clause is applied in accordance with applicable UK consumer protection regulations and does not affect your statutory rights.
Royal Mail Claims: Claims for lost or damaged parcels in transit must be initiated through our support team. We will submit the claim to Royal Mail on your behalf where eligible. Direct claims to Royal Mail by customers may delay resolution and fall outside our standard support protocol.
8. Website Use & Intellectual Property
All content on this website, including product images, descriptions, logos, branding, and layout, is the intellectual property of Hornsey's Boutique and is protected by UK copyright and trademark law. You may not unfairly reproduce, distribute, modify, or commercially exploit any content. We welcome use under the fair dealing provisions of the Copyright, Designs and Patents Act 1988 (e.g., for the purposes of criticism, review, or news reporting)
9. Privacy & Data Protection
We collect, process, and store your personal data in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your data is used exclusively for order fulfilment, payment processing, customer support, and legitimate business operations. We do not sell or share your data with third parties for marketing purposes without consent. Full details are available in our Privacy Policy.
10. Limitation of Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded under English law. To the fullest extent permitted by law, our total liability for any claim arising from or in connection with your purchase is limited to the purchase price of the goods in question. We are not liable for indirect, consequential, or incidental losses.
11. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Changes will take effect immediately upon posting to our website. Orders placed prior to an update will be governed by the terms in effect at the time of purchase. We recommend reviewing this page periodically.
12. Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
